Introduction

Welcome to the website of Bagui Painting & Remodeling LLC. By accepting an estimate, signing a contract, making a deposit, or authorizing work to begin, the Client agrees to the following Terms and Conditions. These terms are intended to explain the general rules for using our website and the general expectations that may apply when requesting painting, remodeling, repair, finishing, or related home improvement services from Bagui Painting & Remodeling LLC. If you do not agree with these terms, please do not use this website or submit information through it.

Bagui Painting & Remodeling LLC provides professional painting, remodeling, and related improvement services for residential and commercial clients in the Denver Metropolitan Area and Northern Colorado. The information on this website is provided for general informational and promotional purposes only.

1.⁠ ⁠Scope of Work

Bagui Painting & Remodeling LLC shall perform only the services specifically described in the approved estimate, proposal, contract, or change order. Any additional work requested by the Client that falls outside the original scope shall require written approval and may result in additional charges.

2.⁠ ⁠Site Access and Work Area

The Client agrees to provide safe and reasonable access to the work area throughout the duration of the project. Delays caused by restricted access, locked areas, pets, personal belongings, vehicles, or unsafe conditions may result in schedule adjustments and additional costs.

3.⁠ ⁠Protection of Property

Reasonable precautions will be taken to protect surrounding surfaces, landscaping, furniture, flooring, fixtures, and personal property. However, the Client acknowledges that construction, remodeling, painting, demolition, sanding, pressure washing, and related activities may generate dust, debris, vibration, noise, overspray, or incidental disturbances.

The Company shall not be responsible for pre-existing damage, hidden defects, or conditions not visible prior to commencement of work.

4.⁠ ⁠Hidden Conditions

The Client understands that concealed conditions may exist behind walls, ceilings, floors, siding, cabinets, trim, crawl spaces, attics, or other structures.Examples include but are not limited to:

•⁠  ⁠Water damage
•⁠  ⁠Mold
•⁠  ⁠Rot
•⁠  ⁠Insect infestation
•⁠  ⁠Structural deficiencies
•⁠  ⁠Electrical defects
•⁠  ⁠Plumbing defects
•⁠  ⁠Code violations

Any such conditions discovered during the project shall be documented and presented to the Client. Necessary corrective work shall be considered additional work and billed separately.

5.⁠ ⁠Material Variations

The Client understands that exact color matching, texture matching, stain matching, sheen matching, wood grain matching, and finish matching cannot be guaranteed due to age, weathering, manufacturer variations, existing conditions, discontinued products, lighting conditions, and normal material differences.

6.⁠ ⁠Manufacturer Products

Bagui Painting & Remodeling LLC is not the manufacturer of any paint, coating, sealant, flooring, siding, hardware, lumber, fixtures, appliances, or building materials used during the project.

The Company does not provide warranties for product defects. Manufacturer warranties, if any, shall be governed exclusively by the manufacturer.

7.⁠ ⁠Workmanship Warranty

Residential projects include a 2.5-Year Workmanship Warranty.Commercial projects include a 3-Year Workmanship Warranty.

The warranty applies only to labor performed by Bagui Painting & Remodeling LLC and does not cover:

•⁠  ⁠Product defects
•⁠  ⁠Normal wear and tear
•⁠  ⁠Abuse or misuse
•⁠  ⁠Structural movement
•⁠  ⁠Water intrusion
•⁠  ⁠Moisture-related issues
•⁠  ⁠Acts of nature
•⁠  ⁠Extreme weather
•⁠  ⁠Lack of maintenance
•⁠  ⁠Modifications performed by third parties

The Client shall provide all replacement materials required for approved warranty repairs. Labor shall be provided at no cost for covered workmanship defects.

Proof of service through an original signed contract, estimate, invoice, or receipt is required.

8.⁠ ⁠Payment Terms

Payment is due according to the schedule outlined in the approved estimate or contract.Failure to make payments when due may result in:

•⁠  ⁠Suspension of work
•⁠  ⁠Delayed project completion
•⁠  ⁠Collection actions
•⁠  ⁠Recovery of legal fees and collection costs permitted by law

9.⁠ ⁠Change Orders

Any modification to the original scope of work must be approved in writing before the additional work begins.Verbal requests may result in delays and are not binding unless documented and approved.

10.⁠ ⁠Weather Delays

Exterior projects may be delayed due to weather conditions including rain, snow, wind, excessive heat, freezing temperatures, or other unsafe conditions. The Company shall not be liable for delays caused by weather or events beyond its reasonable control.

11.⁠ ⁠Limitation of Liability

To the fullest extent permitted by law, Bagui Painting & Remodeling LLC shall not be liable for indirect, incidental, consequential, special, punitive, or economic damages arising from the project.

The Company’s maximum liability shall not exceed the total amount paid by the Client under the applicable contract.

12.⁠ ⁠Photographs and Marketing

The Client grants Bagui Painting & Remodeling LLC permission to photograph completed work for quality control, training, marketing, advertising, social media, website, and portfolio purposes. No personal identifying information will be disclosed without permission. The Client may opt out of this provision in writing prior to project commencement.

13.⁠ ⁠Safety and Hazardous Materials

The Company is not responsible for testing, identifying, removing, or remediating hazardous materials including but not limited to:

•⁠  ⁠Asbestos
•⁠  ⁠Lead-based paint
•⁠  ⁠Mold
•⁠  ⁠Biohazards
•⁠  ⁠Contaminated materials

Discovery of such materials may require immediate suspension of work until appropriate remediation has been completed.

14.⁠ ⁠Dispute Resolution

Both parties agree to attempt to resolve any dispute through good-faith negotiation before initiating legal action.Any legal proceedings shall be governed by the laws of the State of Colorado.

15. ⁠Acceptance

The Client acknowledges that they have read, understood, and accepted these Terms and Conditions by signing the contract, approving the estimate, submitting payment, or authorizing work to begin.

These Terms & Conditions may be updated from time to time to reflect changes in our website, services, business practices, or legal requirements. When updates are made, the “Last Updated” date at the top of this page will be revised. Continued use of the website after changes are posted means you accept the updated terms. We encourage visitors and clients to review this page periodically.
